Overhead door injures storage unit customer
Excerpt from Virginia Lawyers Weekly – July 28, 2008
The plaintiff operated a car detailing business and rented a storage unit from the defendant for his business. On Aug. 25, 2006, when the plaintiff entered the door of his storage unit, the overhead door fell, struck him on the head, and knocked him unconscious. Several weeks prior to this incident, the plaintiff and two of his employees had informed the defendant that the door was malfunctioning. The defendant sent a maintenance man to the unit who worked on the door and informed plaintiff that the door was fixed. An examination of the door after the accident revealed that the track stop on the right side of the door was not installed but was instead sitting on top of a crate inside the storage unit.
