$260K Settlement – Dump truck T-bones car, damages driver’s shoulder

On Dec. 17, 2005, the plaintiff was the operator of a motor vehicle that was struck on U.S. 360 by a dump truck that failed to yield the right of way at the intersection with Route 642.
The plaintiff sustained a hard impact to the left side of her vehicle, with significant invasion into the driver’s compartment. Plaintiff required surgery on her shoulder in February 2008.
Plaintiff’s expert related the injuries to the accident and rated the plaintiff with a 10 percent disability of her upper extremity and shoulder, which would require continuing medical treatment.
The defense requested an exam by Dr. Howard Stern, who agreed with the plaintiff’s treating physician that the shoulder injury was in fact related to the accident in question and that the plaintiff would require future medical treatment.
