$1.3 Million Case Result – Work Injury

Overview:

Tronfeld West & Durrett successfully settled a premises liability case for $1.3 million. The case involved a 17-year-old plaintiff who suffered the amputation of his index and middle fingers on his right dominant hand while using a jointer machine during a woodshop class. The incident occurred as he attempted to dislodge stuck wood from the machine, leading to his injury. The plaintiff alleged inadequate and improper training on the machine’s use and lack of supervision at the time of the accident.

The legal claims included simple negligence, gross negligence, negligent hiring, retention, and negligence per se, citing a special relationship that heightened the duty of care. The defense raised contributory negligence, assumption of risk, and charitable immunity. The case was resolved through mediation with Judge Thomas S. Shadrick (Ret.) on July 19, 2023, resulting in a settlement that covered $12,888.55 in medical bills and $888,073.38 for future prosthetics among other damages.
